Abstract

Chapter K of the book, Texas Environmental Law, provides a study of various jurisdictional and procedural issues related to environmental litigation. First, the chapter discusses several jurisdictional elements, including federal question jurisdiction, diversity jurisdiction, and citizen suit provisions. The chapter then turns to procedural issues including standing, class actions, sovereign immunity, and preemption.
