Civil RICO cases represent a significant and growing portion of all case filings in the federal courts. During the survey period, the Fifth Circuit decided twelve civil RICO cases, more than any other circuit except the Seventh Circuit. Most of the issues addressed or decided were procedural, as the federal courts continue to struggle with the process of construing and applying this much litigated and much discussed statute. Two Supreme Court cases decided this term, dealt with issues considered by the Fifth Circuit although they did not actually come from the circuit. They will also be discussed. |
