dc.description.abstract This article discusses categories of common law discrimination torts, distinguishes categories of common law discrimination torts for preemption purposes, the application to the current law of several states, and future legislative action. The article concludes with the assertion that if a state’s antidiscrimination statute is silent on whether state antidiscrimination laws preempt common law tort claims, the plaintiff should be able to bring an intentional infliction of emotional distress claim. en_US
