Although the Fifth Circuit Court of Appeals considered a number of administrative law cases during the survey period, a great many involved the routine judicial review of agency determinations concerning government benefits under the substantial evidence standard and, therefore, did not address any unprecedented issues. The circuit did, however, reach noteworthy decisions in several cases involving the judicial review of agency decisions as well as in cases addressing issues such as exhaustion, finality, primary jurisdiction, administrative search warrants, and the awarding of attorney's fees; this survey will focus on those cases. |
