Abstract: In this article, the author contends that the U.S. Department of Housing & Urban Development (“HUD”) insufficiently protects voucher tenants from unsavory landlords who can take advantage of voucher tenants’ limited sophistication. This article will first examine the current law on late fees as it pertains to rent in residential leases; second, it will examine why the current policy for the Voucher Program does not adequately protect the voucher tenant; and third, this Article will advocate that HUD should change the current policy in place, and specifically limit the amount of late fees a landlord may charge for late payment of rent under the Voucher Program.
